YAMALUBE SCAN & WIN CONTEST

TERMS AND CONDITIONS 

The YAMALUBE Scan & Win Contest (“Contest”) is organised by Hong Leong Yamaha Motor Sdn Bhd (“Organiser”) on the terms and subject to the conditions herein (“Terms”). By downloading the App (as hereinafter defined) / participating in the Contest, each Participants (as hereinafter defined) expressly acknowledge and agree to be bound by these Terms.

 

1. ELIGIBLE PARTICIPANTS 

The Contest is open to all Malaysian citizens and permanent residents of Malaysia who are aged 18 years and above (as at the commencement of the Contest Period (as hereinafter defined)) based on his/her national registration identity card (“Eligible Participant”), except for persons who are employees of the Organiser during the term of the Contest Period who shall not be eligible to participate in the Contest.

 

2. CONTEST PERIOD 

2.1 The Contest will run from 0:00:00 on 1 October 2023 to 23:59:59 on 30 September 2024 (“Contest Period”). All entries received before or after the Contest Period will not be entertained.

 

3. QUALIFYING CRITERIA 

3.1 Eligible Participants who purchased any Participating Products during the Contest Period shall qualify for participation in the Contest.

3.2 The Participating Products and its respective entry points are as follows:

4. CONTEST MECHANICS 

4.1 For each Participating Product purchased, the Eligible Participant shall be entitled to one entry and only for the Contest Period month in which the Participating Product was purchased.

 

For illustration purposes:

• An Eligible Participant purchases a Participating Product in October 2023. He/she is eligible for one (1) entry during the month of October 2023 only. An entry made for such Participating Product before or after the month of October 2023 will be disqualified.
• An Eligible Participant purchases five (5) Participating Products in October 2023, whether in a single receipt or otherwise. He/she is eligible for five (5) entries during the month of October 2023 only. An entry made for any such Participating Products before or after the month of October 2023 will be disqualified.

For purposes of determining the Grand Prize, Second Prize and Third Prize winners, the total entries made throughout the Contest Period shall be accumulated.

4.2 To participate in the Contest, Eligible Participants are required to download and install the YAMAHA MALAYSIA App (“App”). Upon installation of the App, the Eligible Participants shall be referred to herein as “Participants”.

4.3 After installing the App, Participants shall submit his/her entry via the App by following the steps below:

Step 1: Scan the Participating Product’s QR Code which is displayed on the label of the Participating Product.

Step 2: Fill in the details as required. The address to be provided must be within Malaysia only.

Step 3: Answer the question(s) posted by the Organiser (“Question”) correctly.

Step 4: Upload a clear and legible image of the receipt or invoice for the Participating Product purchased. The receipt or invoice (as the case may be) must bear the details of the Participating Product purchased, date of purchase, purchase price, receipt or invoice number and name and/or logo of the purchasing outlet.

4.4 Submission of any unclear, illegible, inappropriate, incorrect and/or incomplete details, images and/or answers will be disqualified and the Organiser shall not at any time be required to provide any notification, justification and/or explanation for such disqualification.

4.5 The Participant must retain the original receipt(s) or invoice(s) (as the case may be) as proof of purchase of the Participating Product(s) and such receipt(s) or invoice(s) (as the case may be) must be presented to the Organiser for verification during collection of the Prize (as defined in Clause 6 below) or as and when requested by the Organiser, failing which the Organiser may, at its sole and absolute discretion, disqualify such Participant and forfeit such Participant’s Prize.

 

5. ANNOUNCEMENT OF WINNERS 

5.1 40 Monthly Winners

The top 50 Participants who answered the Question correctly and with the highest accumulative entry points (see Clause 3.2 above on the entry points for each Participating Product) for the relevant Contest Period month shall be the winners for that particular Contest Period month.

5.2 Grand Prize, Second Prize and Third Prize Winners

Grand Prize: The Participant who answered the Question correctly and with the highest accumulative entry points throughout the Contest Period.

Second Prize: The Participant who answered the Question correctly and with the second highest accumulative entry points throughout the Contest Period.

Third Prize: The Participant who answered the Question correctly and with the third highest accumulative entry points throughout the Contest Period.

5.3 The Contest Period month, entries accumulation period and Winners (as defined in Clauses 5.1 and 5.2 above) announcement date are as follows:

6. PRIZES 

6.1 The Prizes for the Contest are as follows:

Grand Prize (1 Winner)	One (1) YAMAHA Motorcycle Y16ZR or its active variant
Second Prize (1 Winner)	One (1) YAMAHA Motorcycle Avantiz or its active variant
Third Prize (1 Winner)	One (1) YAMAHA Motorcycle EZ115 or its active variant
Monthly Prize (50 Winners)	One (1) merchandise item worth RM80

 

7.3 The original national registration identity card of the Winners and receipt(s) or invoice(s) (as the case may be) for the Participating Product(s) purchased must be presented during collection of Prizes, failing which the Organiser may at its sole and absolution discretion forfeit the Prizes.

 

7.4 The Prizes are given on an as is where is basis and are non-transferable, non-refundable and non-exchangeable for cash or for otherwise, in whole or in part. The Organiser will not entertain any complaints on the quality and quantity of the Prizes.

 

7.5 The Organiser shall not be liable for any loss or damage that occurs to the Prizes during the delivery or collection process, as the case may be. Any other additional costs (including without limitation travel expenses, transportation cost, duties and taxes) involved in the redemption or collection of the Prizes shall be borne by the Winners.

 

8. GENERAL TERMS 

8.1 The Organiser reserves the right in its sole and absolute discretion, without any prior notice, justification and/or explanation, and without any responsibility and liability to any person in any manner whatsoever, at any time to change any of these Terms (including without limitation the Contest Period, Prizes and winning criteria), and/or to cancel, suspend or postpone the Contest, in whole or in part. Any such change, cancellation, suspension or postponement will be published on the Organiser’s Facebook Page, the Organiser’s Official Website and/or the App.

 

8.2 The Participant shall participate in the Contest at his/her own cost and expense and the Organiser shall not in any manner whatsoever be responsible or liable to reimburse the Participant any cost and expenses incurred even if the Contest is cancelled, suspended or postponed.

 

8.3 In the event of any changes to these Terms and/or the Contest, the Participants hereby expressly agree to the revised Terms. It is the responsibility of the Participant to check for any updates to these Terms from time to time.

 

8.4 The Organiser shall not be liable to the Participant if the performance of all or any part of its obligations hereunder is prevented, hindered, delayed or otherwise adversely affected (whether directly or indirectly) due to or arising from, out of or in connection with an event or circumstance which is beyond the reasonable control of the Organiser or its consequences.

 

8.5 Each Participant agrees and undertakes to release, indemnify and hold harmless the Organiser, its affiliates and subsidiaries, and their respective employees, directors, officers and agents, from and against any and all claims, demands, causes of actions or liabilities, losses, damages, judgments, suits, settlements or the like entered into by any of the aforesaid (whether or not liability is admitted by any of them), costs and expenses, and other actions of any kind, arising directly or indirectly out of any act or omission of the Participant.

 

8.6 To the fullest extent permitted by applicable laws, the Organiser offers no warranty or representation whatsoever, express, implied or statutory, in relation to the Contest and the Prizes, including without limitation, the merchantability and quality of the Prizes. Any queries related to the Contest should be made directly to the Organiser.

 

8.7 Notwithstanding anything herein contained, the Organiser’s aggregate liability under these Terms or otherwise howsoever arising shall be limited to RM1,000 only.

 

8.8 The Organiser does not accept any responsibility for late or lost entries due to Internet and/or other technical issues. Proof of the Participant’s entry shall not in any manner be deemed or considered as proof of the Organiser’s receipt.

 

8.9 The Organiser accepts no responsibility for ineligible entries or entries made fraudulently.

 

8.10 Without prejudice to the rights herein contained, the Organiser further reserves the right to disqualify any Winners or entries in the following events:

(a) any non-compliance or breach of any provisions of these Terms by the Winner or Participant;

(b) the entries are or are suspected of being related to counterfeit products; or

(c) the Winner and/or his/her companion(s) behaves or behaved in a manner that, in the Organiser’s view, may tarnish the reputation of the Organiser and/or its affiliated companies and their respective businesses.

 

8.11 The Organiser will not be liable for any taxes or levies whatsoever in respect of the Prizes and such will be the sole responsibility of the winner(s).

 

8.12 Winners may be required to be photographed and appear in a video shoot prior, during, and/or after the Prize collection and/or giving ceremony and the Organiser reserves the all the rights in respect thereof, including without limitation, the right to broadcast, publish, display information including without limitation the names, photographs and/or videos of any or all Winners for marketing, advertising and/or publicity purposes and/or in any manner it deems appropriate, with no monetary payment whatsoever payable to the Winners.

 

8.13 All decisions made by the Organiser in relation to the Contest shall be final, conclusive and binding on the Participants. No further correspondence, queries or appeals shall be entertained.

8.14 In the event of a conflict in the interpretation of these Terms and any translation of it in any language (if any), this English version shall prevail.

 

8.15 These Terms shall be governed by and construed in accordance with laws of Malaysia.

 

9. PRIVACY NOTICE 

9.1 Each Participant acknowledges and agrees that all personal data disclosed directly or indirectly by the Participant to the Organiser in the participation of the Contest will be collected, used, stored, processed, transferred and/or shared by the Organiser with its affiliates or subsidiaries, sponsors, partners and/or any other relevant third parties (“Permitted Person”) who may use or process such personal data, for purposes relating or incidental to or associated with the Contest for as long as the Organiser and/or the Permitted Person require and on the terms and conditions as agreed by the Organiser and any of the Permitted Person.

 

9.2 Without prejudice to the provisions hereunder, the Participant hereby accepts and agrees to be bound by the Orgniser’s privacy policy (“Privacy Policy”), an electronic copy of which is available at https://www.hli.com.my/downloads/group_privacy_policy.pdf. The Privacy Policy may be amended and updated from time to time at the Organiser’s sole and absolute discretion without notice to the Participants. The collection, use, storage, processing, transfer and/or sharing of any personal data received by the Organiser from the Participants are subject to the provisions of these Terms and the Privacy Policy.
